Terms, disclaimer and privacy

The short version. OnlyAlpha publishes market data, charts and mechanical signals for education. It is not investment advice and it is not personalized to you. You make your own decisions and you are responsible for them. Investing involves risk, including the loss of everything you invest. Backtests are hypothetical. You can cancel a paid plan at any time.

1. Who we are

OnlyAlpha (“OnlyAlpha,” “we,” “us”) operates the OnlyAlpha website and its related emails (together, the “Service”). By using the Service or subscribing to it, you agree to these terms. If you do not agree, do not use the Service.

2. Not investment advice

Everything OnlyAlpha publishes, including the Pivot, the Score, Warehouse and Inventory status, buy and sell signals, lists, screens, the capitulation gauge, backtests and the daily email, is general, impersonal information published for educational purposes. It is the same for every reader and does not take into account your objectives, finances, tax situation, risk tolerance or circumstances.

OnlyAlpha is not a registered investment adviser, broker-dealer or financial planner, and nothing in the Service is a recommendation or solicitation to buy, sell or hold any security.
We do not manage money, hold customer funds, place trades for you or give individual advice, including by email or reply.
Signals are mechanical outputs of fixed rules. A signal is not a statement that a security is suitable for you.
Talk to a licensed professional before making investment, tax or legal decisions.

3. Risk and performance

Investing in stocks, funds and other securities involves risk, including the possible loss of all principal. Leveraged and inverse funds carry additional risks and can lose most of their value quickly.

Backtested, simulated and hypothetical results shown on the Service are computed with the benefit of hindsight, do not represent actual trading, and do not reflect trading costs, slippage, taxes or the effect of real-world decisions. Our historical studies use companies that are in our data today and under-represent companies that failed or were acquired, which can make results look better than they would have been. Past performance, real or hypothetical, does not guarantee future results.

4. Data accuracy

Prices, dividends, holdings, filings and other data come from third-party and public sources and are updated after the market close. They may be delayed, incomplete or wrong. The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, timeliness or fitness for a particular purpose. Do not rely on the Service as your only source of information.

5. Subscriptions, billing and cancellation

Free plan. The website and the free daily email are free. We may change or end free features at any time.
Paid plans renew automatically at the end of each billing period (monthly or yearly) at the price shown when you subscribed until you cancel. Payments are processed by Stripe; we never see or store your full card number.
Founding member pricing stays at the founding price for as long as your subscription stays active without interruption. If you cancel and come back later, current pricing applies.
Cancel any time from the billing link in your receipt or by emailing us. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Refunds. If you are not happy within 7 days of your first paid charge, email us for a full refund of that charge. After that, payments are non-refundable except where the law requires otherwise.
We may change prices for future billing periods; we will email you at least 14 days before a price change applies to you.

6. Acceptable use

The Service and its content are for your personal, non-commercial use. You may not resell, republish, redistribute or systematically copy the Service’s signals, lists or data, share paid content or account access with others, scrape the Service, or use it to provide advice to third parties. We may suspend or end access for misuse.

7. Intellectual property

The Service, including its design, text, charts, signals, names such as OnlyAlpha, the Pivot and the Score, and its methods, belongs to OnlyAlpha. Company filings and third-party data remain the property of their owners.

8. Limitation of liability

To the fullest extent the law allows, OnlyAlpha and its owner will not be liable for any trading or investment losses, or for any indirect, incidental, special, consequential or punitive damages, arising from your use of or reliance on the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

9. Privacy

What we collect: the email address, first name and stock list you give us when you sign up; billing details handled by Stripe if you subscribe; and basic, anonymous site usage collected by our host.
How we use it: to send the emails you asked for, run your account and billing, answer you, and improve the Service.
We never sell or rent your personal information. We share it only with the providers that run the Service (for example our website host Cloudflare, our payment processor Stripe and our email provider), and when the law requires it.
Your choices: unsubscribe from any email at any time by replying “stop” or using the unsubscribe link, and email us to see, correct or delete your information.

10. Changes and governing law

We may update these terms; the date at the top shows the latest version, and continuing to use the Service means you accept the update. These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.
